1. OBJECT AND SCOPE OF APPLICATION

1.1. The website aims to teach programming in Swift, as well as other tools commonly used as a software developer, offering Internet users information about the world of iOS development through a method designed by professional developers, with articles, tutorials, and live classes, so that the user can access as much information as possible on iOS application development.

1.2 EducaSwift may, at any time and without prior notice, modify these Terms and Conditions of Use.

1.3.- In addition, to participate in the tutorials, one must consider and adhere to the following rules to manage it correctly, following ethical and appropriate guidelines to avoid unwanted behaviors. Consequently, EducaSwift reserves the right to suspend, either temporarily or permanently, the accounts of users who have violated any of the site’s rules.

1.3.1. Advertising, Spam, and links to other pages. The site has measures to control unwanted advertising, but just in case, we must warn that certain types of messages are not allowed and will be deleted without notice. 1.3.2. Link to a personal blog. Signatures are not enabled in EducaSwift to keep tutorials cleaner, so manual entries are also not allowed. However, you may link any relevant posts without any problems.

1.3.3. Links to copyrighted material, pirated programs, cracks... The forum is not a place for exchanging copyrighted material. Additionally, posting about illegal sites or ways to bypass current laws will not be allowed, regardless of the user’s intent.

1.3.4. Activities prohibited by law.

1.3.5. Offensive language. Closely related to point 3. Try to be polite.

1.3.6. Actions that disrupt the tutorials. Try not to write in all caps. Repeated or duplicate messages will not be allowed. Nor is “flooding” (writing empty messages to increase the number of posts); “bumping” old threads that are no longer relevant; or “pushing” (posting in a thread previously opened by you to bring it to the top of the forum). Also, changing font size, color, or style without a specific purpose.

1.3.7. Moderation. Moderators can delete/move posts and ban users for serious offenses without prior notice. Moderator decisions are not debated in public. If you have a complaint, address it privately with them.

1.3.8. Spanish-speaking forum. The official language of the forum is Spanish.

1.3.9. Publishing personal data. We advise against posting personal data, including email addresses, Skype, phone numbers, etc., for your security, whether in the forum or private messages. We cannot be held responsible for any consequences if you do so.

2. ACCESS AND USE OF THE WEBSITE


2.1 Access to www.educaswift.com by Internet users is free. Users should keep in mind the provisions in the General Terms of Use.

2.2. Personal Access Key.

The user will be responsible for the use and custody of the provided access key on www.educaswift.com. EducaSwift is not liable for the loss, misplacement, or misuse of these keys or passwords, nor for damages caused to the website, EducaSwift, or third parties by actions or omissions by this user or third parties using the key or code, violating these Terms and Conditions of Use.

2.3. The data provided by the user during registration to access restricted areas of the website, as well as the treatment and possible transfer of personal data, will comply with the provisions in Section 7 related to Personal Data Protection.

2.4. Creating more than one user account for a given physical person, as well as accessing the website using another user's username and password, is prohibited. Additionally, it is forbidden to provide access to other users by sharing one’s user credentials.

2.5. EducaSwift reserves the right to suspend accounts created for purposes other than receiving training through the School’s level system, such as attempts to use the EducaSwift platform for advertising, client solicitation for personal benefit, or any other illegitimate use of the School’s tools.

Should any of the above conditions be violated, EducaSwift reserves the right to immediately suspend the registered user’s access to the website.

3. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

3.1 The contents, structure, design, and presentation format of elements (texts, graphics, images, files, logos, color combinations, and any element subject to protection) are protected by intellectual or industrial property rights owned by EducaSwift.

3.2 Reproduction, transformation, distribution, public communication, making available to the public, and any other form of exploitation, partial or total, of the elements referred to in the previous paragraph, are prohibited. These exploitation acts may only be carried out with the express and written authorization of EducaSwift, and in all cases, must explicitly reference EducaSwift’s ownership of the intellectual property rights.

In this sense, the user is authorized exclusively for private and personal use of the website content, provided intellectual and industrial property rights are respected. Under no circumstances may the user suppress, alter, circumvent, or manipulate any protective devices or security systems that may be installed.

If an active user offers training or teaching to third parties, EducaSwift reserves the right to restrict access to content for that user, after notification.

3.3. In no case will it be understood that user access and browsing imply a waiver, transmission, license, or total or partial transfer of such rights by EducaSwift or collaborators.

3.4 The distinctive signs (trademarks, trade names) displayed on this site are protected by industrial property rights, prohibiting the use or manipulation of any of them without the express and written authorization of EducaSwift or the legal owner of the displayed distinctive signs.

4. DISCLAIMER OF LIABILITY

4.1 The user acknowledges and accepts that access and use of the website are carried out at their own risk and responsibility.

4.2. EducaSwift is not responsible for damages that may arise from, including but not limited to (i) Interferences, omissions, interruptions, computer viruses, malfunctions, and/or disconnections in this electronic system’s operational function or in the customer’s computer equipment, caused by external factors beyond EducaSwift’s control; (ii) Delays or blocks in usage due to Internet deficiencies or overloads in other electronic systems; (iii) Actions by third parties involving unauthorized interference outside EducaSwift’s control; (iv) Impossibility of providing the Service or allowing access due to causes not attributable to EducaSwift caused by the User, third parties, or force majeure.
